Introduction - Top |

1.1 |
For the purposes of these rules, persons or
organizations producing and presenting programs to be cablecast for a
community program channel will be called the "Producer" and the Cable TV
system owned by Time Warner will be called the "Company."

|
|
1.2 |
Use of the Company's equipment, facilities,
channel time and technical assistance are provided on a first-come, first
served basis, at no charge, subject to availability.
The company reserves the right to refuse service to anyone.
|
|
| 2. |
The Request Form - Top |
|
|
2.1 |
To apply for use of Company equipment or
channel time, you must complete the company "Request for Community Programming
Coordinator" form at least 60 days prior to the expected beginning of a project.

|
| 3. |
Conditions for Airing - Top |
|
|
3.1 |
"The Conditions for Airing" is an
agreement with the Company to abide by these rules. Read the
rules and the "Conditions for Airing" completely before you sign.
If any part is unclear, ask someone to explain.
|
|
|
3.2 |
The Community Programming
"Conditions for Airing" must be completed and accepted
before the date of transmission of a completed program or
before any production work may begin.
|
|
| 4. |
Program Content - Top |
|
|
4.1 |
LENGTH: All programs submitted
for cablecast of a series shall be no less than 25 minutes and
no longer than 30 minutes in total duration (this does not apply
to special programming).
|

|
4.2 |
LOCALLY PRODUCED: All tapes submitted to
the Community Access Channel 20 must be locally produced by individuals
residing in the Time Warner Cable of San Antonio service area.
|
|
|
4.3 |
ADVERTISEMENTS: Advertisements of
any form are prohibited in any Community Program unless approved by
the Company or as specifically outlined in Section 5 of these rules.
|
|
|
4.4 |
LOTTERY: The Company prohibits the
presentation of any advertisements or information concerning any
lottery, gift enterprise, contest or similar scheme.
|
|
|
4.5 |
OBSCENITY: The Company prohibits
the presentation of obscenity or other material unprotected by the
U.S. Constitution. All other programs of "mature" content will be
scheduled at an appropriate hour. Time scheduling decisions will be
made at the Company's discretion.

|
4.6 |
If the Company determines that any
program contains material prohibited in Sections 4.1 - 4.5, the
Producer shall be given the opportunity to revise the program so
as to delete the objectionable portion. If the Producer chooses
not to do so, the Company has the right to NOT show the program.
|
|
|
4.7 |
The Company's determination as
to whether any or all of the Producer's program material is prohibited
by Sections 4.1 - 4.3 may be appealed to the City of San Antonio.
|
|
|
4.8 |
The Producer agrees to hold the Company's
officers, directors, employees, or those of any other cable television system,
harmless from any liability, loss or damage, including reasonable attorney's
fees, caused by or arising out of the Producer's utilization of Company's
cable casting equipment and/or channel time.
|
|
| 5. |
Sponsorship - Top |
|
|
5.1 |
So that Community Program users may
give reasonable credit to those persons or organizations who have
supported the production of their program material, producers may
insert into their programs an announcement indicating sponsorship
support for the program. Sponsorship announcements must
precede the opening scene, or follow the closing scene of the program.

|
5.2 |
Sponsorship announcements may consist
of an audio and video segment, structured as follows:
|
|
5.2a |
the announcement will consist
of a statement of the following format: "The following (preceding)
program has been made possible through the support of..."
followed by the listing of the persons or organizations.
|
|
|
5.2b |
the video portion will consist
of a written statement listing the persons or organization
providing sponsorship. No other information
regarding the organization will be permitted.
|
|
|
5.2c |
in cases where more than one
person or organization is involved, each organization or person
may be listed separately. All such listings would be presented
in the same type-face or style.
|
|
|
| 6. |
Public Inspection of Records - Top |
|
|
6.1 |
The Company maintains a complete record
of the names and addresses of all persons or groups requesting the use
of Community Programming facilities. This record is available for public
inspection during regular business hours at 8434 Gault Lane, San Antonio,
Texas 78209. All records of request for use of Community Programming
facilities will be retained for a period of two (2) years. Any additional
information regarding Public Access users shall remain confidential.

6.2 |
Use of Community
Programming equipment and/or channel time shall not
be made available to any person or group who does
not provide a local working phone number and address.
|
|
|
6.3 |
Persons requesting
public inspection shall identify themselves by name
and address, in order to permit the Company to maintain
administrative control of such records.
|
|
| 7. |
Studio Usage - Top |
|
|
7.1 |
Producers must provide personnel to operate studio cameras. Prior to your scheduled appointment, your coordinator will discuss the number of operators necessary for your production.
|
|
|
7.2 |
Time Warner Cable will provide the technical assistance necessary in the operation of studio equipment in other areas of the production.
|
|
|
7.3 |
Studio time for each producer will be limited to no more than one production schedule per calendar month based on studio availability (special programming is included).
|
|
|
7.4 |
It is the sole responsibility of the Producer to contact the assigned coordinator with your request to schedule studio time.
|
|
| 8. |
Uses of Community Programming Equipment - Top |
|
|
8.1 |
Use of any Community Programming equipment provided to the Producer by the Company is for the purpose of creating Community Programming material only and shall be limited to the program or programs named in the "Request" form. No commercial use of the equipment is allowed.
|
|
|
8.2 |
The person who signs the "Conditions for Airing" is responsible for all the equipment provided by the Company, and will make restitution to the Company for any equipment defaced, damaged, lost or rendered inoperable while under the responsibility of the Producer. Equipment responsibility may not be assigned to any other organization or individual.
|
|
|
8.3 |
Community programming equipment may be picked up, used, or returned only by persons who have completed either the “Request for Access Coordinator” or the “Request for Facilities & Equipment Usage” form.
|
|
|
8.4 |
The Producer will allow no one to service, repair, or adjust any Company-owned equipment. All service, repairs, and adjustments will be provided by the Company at a minimum fee of $25 per incident.
|
|
|
8.5 |
Company-owned equipment will be provided free-of-charge to the Producer for a previously determined time period (usually 24 hours). Failure to return equipment at the specified time and place, however, will constitute a violation of these rules, and the Producer will be charged a late fee for every hour past due at a one hour minimum. Any charge assessed to a Producer must be paid in full before any future services (i.e., airtime, equipment, facilities, etc.) will be provided through Company Community Programming facilities.

8.6 |
The Company reserves the right to inspect the use of Company-owned equipment at any time and the right to demand immediate return of any or all of the equipment in the Producer's possession, should it determine that the applicant has failed to abide by the conditions set forth herein.
|
|
|
8.7 |
Company equipment may not be used or transported outside of a distance of forty (40) miles from downtown San Antonio without written permission from the Company.
|
|
|
8.8 |
Company equipment may not be transported in any airplane, boat or motorcycle except with specific written permission from the Company.
|
|
| 9. |
Technical Standards - Top |
|
|
9.1 |
All program material shall comply with the standard for video signals set forth by the Company.
|
|
|
9.2 |
The Company shall have sole discretion to determine compliance of program material with the standards set forth in this section.
|
|
|
9.3 |
The Company may prohibit presentation of any material not found in compliance with the standards set forth herein.
|
|
9.3a |
All programs to be cablecast will be submitted to the Company on ½ " VHS, ½ " SUPER VHS, or ¾ " U-Matic video cassette format (completed programs only). Weekly programs shall be no longer than thirty minutes in length. For producers not requiring weekly programming or for those programs in excess of 30 minutes in length, a request for “Special Programming” can be made which will be limited to no more than one program per quarter.

9.3b |
Video signals recorded on tape shall conform to all applicable FCC standards.
|
|
|
9.3c |
Video level of any scene recorded on tape shall be no lower than forty (40) IRE units overall (LOW LIGHT LEVEL).
|
|
|
9.3d |
Producers must provide brand name High Grade broadcast quality tapes for use in their productions. In addition, only one program is allowed per tape.
|
|
|
9.3e |
Audio shall be recorded at a peak level of 100% VU (0dB). Audio, which is consistently recorded over this level, or consistently falls below -7 dB will not be played back into the system.
|
|
|
9.3f |
All VHS tapes must be recorded at the Standard Play (SP) speed for both editing and broadcasting purposes.
|

|
| 10. |
Miscellaneous - Top |
|
|
10.1 |
MINORS: Company equipment will not be made available to minors under the age of 18, except where direct adult supervision may be demonstrated to the satisfaction of the Company. The supervising adult must all Company-provided training session with the minor and assume the responsibilities of producer. The supervising adult must either be the minor’s parent or legal guardian.

|
10.2 |
PROMOTION: No Producer may use the corporate name, or initials in any advertising or solicitation without express consent of the Company. In cases where the Company gives consent for such use, the Company has the right to review and approve advertising copy in advance.
|
|
|
10.3 |
WHO CAN PRODUCE: Only those adults residing in the Company's service area and providing locally produced tapes are eligible to use Community Programming facilities and services. Each Producer is allowed one project at a time. Each project must be completed before a new one is started.
|
|
| 11. |
Distribution and Sale of Community Programs - Top |
|
|
11.1 |
Any program produced in whole or in part by Company staff, or with Company-owned equipment may not be distributed for profit or sold without express written permission from the Company. If you wish to distribute your program for commercial purposes, we would ask that you enter into a written agreement to recoup our costs from a portion of your profits.

Portable Equipment - Top |
|
|
12.1 |
Community Programming Producers who will be borrowing portable video equipment will be required to provide proof of insurance and/or sign a financial responsibility waiver prior to scheduling of equipment.
