Terms of Service

Welcome to Time Warner Cable Digital Phone Local residential telephone service! Below we provide you additional information regarding Time Warner Cable Digital Phone Local and the terms and conditions of the service.

The Digital Phone Local Plan

Digital Phone Local allows Time Warner Cable customers to call anyone, anytime, anywhere in your local calling area for one low price of $24.95. You also receive, at no extra charge, popular calling features such as Caller ID on TV* (effective June 4, 2006) Caller ID, Call Waiting, Caller ID with Call Waiting, Call Forwarding, and more! In addition, we offer Voicemail as an optional enhancement to your Digital Phone Local service for $3.95 per month. Finally, with Digital Phone Local service, you may keep your telephone number from your existing phone provider and connect multiple phones in your home to the Digital Phone Local service.

With Digital Phone Local, you will also receive 10 minutes of free long distance calling anywhere within the United States, Canada, and Puerto Rico. Additional long distance calling outside of your local calling area will be billed to you at 5 cents per minute.

Digital Phone Local Features

As part of your Digital Phone Local plan, you will receive Call Waiting, Caller ID, and Call Waiting ID. Call Waiting alerts you when there’s another incoming call. Caller ID identifies incoming calls before you answer the phone and Caller ID Call Waiting allows you to identify a caller when on the phone with another person. You must have either Caller ID display equipment or a Caller ID display already built into your telephone. At this time, Digital Phone Local service does not support fax or dial-up Internet calls. While these communications may work occasionally using Digital Phone Local, Time Warner Cable recommends that you keep a simple, low cost analog phone line from your existing telephone company for the use of fax or dial-up Internet service. Time Warner Cable plans to introduce enhancements and products to support fax and dial-up Internet later this year or early next year.

Additional Charges

Calls to international locations are offered at an extra charge and will also be billed on a separate line of your Time Warner Cable bill. Rates for calling to all locations outside the United States, including Mexico, Canada, the Caribbean and U.S. Territories can be found by clicking here.

Directory Assistance and Operator Services

Calls to Directory Assistance (411) and Operator Services (0) are offered at an extra charge and will be billed on a separate line of your Time Warner Cable bill. Current rates for Directory Assistance and Operator Services are as follows:

Billing

We will bill you for the Digital Phone Local service each month in advance on your Time Warner Cable statement. In addition to charges for other Time Warner Cable services, your statement will include a line item for the Digital Phone Local service, and an additional line item for any charges that may result from Long Distance calling, Directory Assistance and Operator Services and calls to international locations. You will not be charged for installation, disconnection, or termination of your Digital Phone Local service.

In addition to your Time Warner Cable statement, you will be able to view all of the details relating to the calls made through your Digital Phone Local service on a secure web site, which you may access at twc-sa.com/digitalphonelocal. This includes details relating to your intrastate and interstate long distance, in addition to calls to international locations, Directory Services and Operator Assisted calls. You will not receive this call detail information with your Time Warner Cable statement, but can view it any time on the web. In addition, should you wish to receive a particular month of call detail records in the mail, you may contact Time Warner Cable at 210-244-0500.

As with your existing services, your Time Warner Cable statement, including charges associated with your Digital Phone Local service, will be payable and due on the due date indicated on the statement. It is the customer’s responsibility to report billing errors immediately upon receipt so that the service levels can be verified. Time Warner Cable is not responsible for disputed services charges not reported within 90 days of initial billings. To receive credits or rebates for interruption of service, call Customer Service or send a written request. A late charge of 1.0% will be assessed upon any unpaid Digital Phone Local balance thirty (30) days after services to which the late fee applies have been received by the consumer. Additional administrative and/or collection charges may be levied for cable or Internet services not paid in full by the due date on your Time Warner Cable bill. All services must be current to avoid disconnection. You are a subscriber to a bundled local telephone service. If you receive Time Warner Cable video and/or high speed Internet services in addition to Digital Phone Local service, then you are a subscriber to a bundled local telephone service. Please note that if you do not pay your entire bill for bundled local service, all components of the bundled local service are subject to disconnection. This includes your cable television and/or high speed Internet service, as applicable. You do not have the right to retain selected components of the bundled local service by paying for only those components. Account holders are liable for all services rendered by Time Warner Cable prior to customer’s request to terminate service. All equipment remains the property of Time Warner Cable. Finally, nonpayment of any portion of your statement’s charges for cable television, high speed data, and/or Digital Phone Local services could result in disconnection of each of these services.

In addition to these items, your Time Warner Cable billing statement will include regulatory fees associated with your Digital Phone Local service. On your statement, for instance, you will see an Enhanced 9-1-1 Surcharge, which is a charge billed on behalf of the municipality in which you live. Your local government asks that you pay this small charge each month to help provide for emergency services to your community. In addition, your statement may include a State or Federal Universal Service Fund contribution, which is to recover the amount that telecommunications providers must contribute to the Federal Universal Service Fund, a fund that helps keep local phone rates affordable.

Other Terms

Digital Phone Local does not include back-up power and, as is the case with an electricpowered home cordless phone, should there be a power outage, Digital Phone Local, including the ability to access emergency 911 services, will not be available. Any battery included in my voice-enabled cable modem may enable back-up service for a limited period of time or not at all, depending on the circumstances, but the inclusion of the battery does not ensure that Digital Phone Local Service will be available in all circumstances involving a commercial power outage.

Digital Phone Local will operate with monitored security systems. However, Digital Phone Local does not include back-up power and, as is the case with an electric-powered home cordless phone, should there be a power outage, Digital Phone Local will not be available. If this is a concern, Time Warner Cable recommends keeping an analog line from your previous phone service provider for the security system. Time Warner Cable, similar to traditional phone service providers, does not install, support, or service monitored security systems. In the event that Time Warner Cable installs and configures Digital Phone Local with your home security system, you must contact the provider of your alarm monitoring services in order to test the compatibility of the alarm services with Digital Phone Local. Time Warner Cable will not be responsible for the cost of conducting any tests or configuring your alarm monitoring system.

Upon your receipt of this information, you may, for any reason, cancel your order for Time Warner Cable Digital Phone Local without any penalty or further obligation. As with all Time Warner Cable products, you’re also eligible for a 30-Day money back guarantee. Additional services incurred during the first 30-days, such as calls to international locations, Directory Services and Operator Assistance are independent of this guarantee and will be billed and due in case of cancellation.

Finally, your Time Warner Cable Digital Phone Local service is governed by the Time Warner Cable Digital Phone Subscriber Agreement you received with your installation materials and the Subscriber Privacy Notice you received with your installation materials.
